These Terms & Conditions (“Terms”) govern your access to and use of elevatebiz.co (the “Site”) and the services offered by Elevate Digital Solutions LLC(“Elevate,” “we,” “us”). By using the Site or engaging our services, you agree to these Terms. If you do not agree, do not use the Site.

Our services

Elevate provides AI consulting and implementation (such as AI assistants, custom CRMs, dashboards, and automations), along with social media content, paid advertising management, and website and branding services. The specific scope, deliverables, timeline, and price for any engagement are defined in a separate written proposal or agreement between you and Elevate, which controls if it conflicts with these Terms.

No guarantee of results

Any figures, metrics, examples, or outcomes shown on the Site are illustrative only and do not represent a promise or guarantee of results. Business results depend on many factors outside our control, including your market, offer, pricing, effort, and execution. Elevate does not guarantee any specific level of leads, bookings, revenue, savings, or return.

Free consultation

A “free AI game plan” or consultation is provided at no cost and without obligation. It is informational and does not create a client relationship or any commitment to purchase.

AI-generated outputs

Some deliverables involve artificial intelligence. AI systems can make mistakes and may produce inaccurate or unexpected output. We build with human oversight and reasonable safeguards, but you are responsible for reviewing outputs before relying on them, and Elevate is not liable for decisions made solely in reliance on AI output.

Your responsibilities

• Provide accurate information and timely access, approvals, and materials we need to do the work.
• Use anything we build in compliance with applicable laws and the terms of any third-party platforms (e.g., Meta, Google, phone/SMS providers), including consent and messaging rules.
• Maintain your own backups and credentials, and keep account access secure.

Fees & payment

Fees are set out in your proposal or agreement. Unless stated otherwise, invoices are due on receipt, fees are non-refundable once work has begun, and third-party costs (such as ad spend and software subscriptions) are your responsibility.

Ownership & intellectual property

Upon full payment, you own the final deliverables we create specifically for your business, as described in your agreement. Elevate retains ownership of its own pre-existing tools, frameworks, templates, and know-how, and of all content, design, and code of this Site. You may not copy, resell, or reverse-engineer the Site or our materials without permission.

Third-party services

Our work may rely on third-party platforms and services. We are not responsible for their availability, changes, pricing, or actions, and your use of them is subject to their own terms.

Disclaimer of warranties

The Site and services are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, Elevate and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim arising out of the Site or our services will not exceed the amount you paid to Elevate for the services giving rise to the claim in the three (3) months before the event.

Indemnification

You agree to indemnify and hold Elevate harmless from claims, damages, and expenses arising out of your use of the Site or services, your content or data, or your violation of these Terms or applicable law.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Texas, and you consent to that jurisdiction.

Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted here; your continued use of the Site means you accept them.
